“NBC UNIVERSAL ON THE SET” NATIONAL DIGITAL VIDEO CONTEST 2007 OFFICIAL RULES


NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

1. CONTEST DESCRIPTION: “NBC UNIVERSAL ON THE SET” NATIONAL DIGITAL VIDEO CONTEST (“Contest”) is a skill contest in which a student, 14-18 years of age, submits a video answering one of two questions asked about Television and Diversity (the “Video”). Entry submissions will be accepted beginning April 7, 2007. Contest ends May 7, 2007.

2. ELIGIBILITY: This Contest is open only to students, who are legal residents of the 50 United States including the District of Columbia, 14-18 years of age, whose parent/legal guardian is a current cable subscriber at time of entry. Employees of NBC Universal Cable (“Sponsor”), NAMIC, the Cable Center, Pickerel Pie (Promotional Partners), and each of their parents, affiliates, subsidiaries, advertising and promotional agencies, prize providers, participating retail locations and each of their respective officers, directors, employees, and agents (“Sponsor and its agents”) and members of the immediate family and persons living in the same household of each are ineligible. Contest ends at 11:59:59 PM (ET) on May 7, 2007.

3. TO ENTER: To obtain copies of the Official Entry Forms, log onto http://nbcuontheset.com and print out the Official Entry Form materials (which consist of a Student Entry Form and a Teacher Recommendation Form) (“Official Entry Forms”) or call 1-866-787-NBCU(6228). To be eligible, each Entrant must complete the entire Official Entry Forms and submit an original Video responding to one of the two questions below. One of the following questions must be answered for the Entry to be eligible. The Entry questions are as follows:

a. When we talk about diversity, we mean acceptance, respect, understanding and celebration of the things that make people or groups different from one another. Given this definition of diversity, take a personal experience on how diversity has affected your life and write an overview for a television episode that would star you as the main character.

b. Television is changing…now you can watch programs on TVs, computers, telephones, in high-definition, streamed clips, etc. ON THE SET’S goal is to continue to change television by recruiting people with different backgrounds, ethnicities and experiences that will generate a broader range of creativity and ideas for programming.
The year is 2025. Tell us what television will be like. Give us an example of how people will watch and what they will be watching.

There are 2 ways to enter this Contest:

(1) Enter Online: Go to the www.nbcuontheset.com (the “Website”). Video can be uploaded from the link found on the Digital Video Contest page found on the Website. Online Video submissions must be submitted by 11:59 p.m. (E.S.T.) on May 7, 2007. During the Entry Period, fax the completed Official Entry Forms (the Student Entry Form and the Teacher Recommendation Form) to (201) 735-3630 or mail the completed Official Entry Forms to: “NBC UNIVERSAL ON THE SET” National Digital Video Contest, Attention: G. DaDan, 900 Sylvan Avenue, Englewood Cliffs, New Jersey 07632. Official Entry Forms submitted via fax must be submitted by 11:59 p.m. (E.S.T.). Official Entry Forms submitted via U.S. Mail must be postmarked no later than May 7, 2007, and received no later than May 14, 2007.

(2) Enter by U.S. Mail: During the Entry Period, you may enter this Contest by mailing completed Official Entry Forms (the Student Entry Form and the Teacher Recommendation Form) and Video to: “NBC UNIVERSAL ON THE SET” National Digital Video Contest, Attention: G. DaDan, 900 Sylvan Avenue, Englewood Cliffs, New Jersey 07632. All entries must be postmarked no later than May 7, 2007, and received no later than May 14, 2007.

Video must be no longer than two (2) minutes. Video uploaded online at the Website must be submitted in one (1) of the following electronic formats: QuickTime (.mov) or Windows Media (.wmv) files. Video must be no larger than 6MB. Videos submitted via the U.S. Mail shall be ineither, CD, DVD or VHS format. Video must be in English and be original, truthful, unpublished, created solely by the submitting entrant, must not have been submitted in any other competition, and must not infringe upon any rights as of any third party, including but not limited to copyright, trademark, and rights of privacy and publicity. Video must not include copyrighted music. No additional materials (photos, artwork, samples, etc.) will be accepted with your submission. If additional materials are sent, they will be discarded prior to judging. Each Entrant must also provide the following information on the Official Entry Form to be eligible: the student’s name, student’s age, student’s parent name, student’s home address, parent’s home telephone number, parent’s daytime phone number, student’s current grade level, student’s school name, name of the teacher providing the recommendation, school principal, school address, school telephone number, cable operator, the student’s signature and his/her parent/legal guardian’s signature. Entries become the property of Sponsor and will not be returned. Each Entry submitted must be accompanied by the Teacher Recommendation Form to be eligible. Entrants’ information will be used solely for identification purposes. Each Entrant may enter the Contest no more than one (1) time. If more than one (1) entry is received from the same Entrant, only the first entry submitted by that Entrant will qualify for entry into the Contest. Subsequent entries submitted by that Entrant will be disqualified. Entry must be in keeping with the Sponsor’s image and will not be defamatory, libelous, pornographic or obscene. Sponsor shall have the right, in its sole discretion, to edit, composite, duplicate or alter the Video submission for any purpose which Sponsor deems necessary or desirable, and each Entrant irrevocably waives any and all so-called moral rights they may have in the Video submission by him or her. Sponsor is not responsible for malfunctions of electronic or telephone equipment, computer hardware, software, malfunctions of the entrant’s email provider, lost, late, incomplete, misdirected entries or entries not received in time. By submitting a Video, you are at such time granting Sponsor and its agents a worldwide, royalty-free, perpetual, unrestricted, irrevocable and fully sublicensable right and license to consider, disclose, broadcast, use, re-use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, re-distribute, publicly perform and/or display your video (in whole or in part) and/or incorporate all or part of your Video in other works, in any form, format, media or technology now known or later developed. Entries not containing the required information, entries in excess of the stated limit by the same person, and entries not submitted in the required format will be disqualified. Proof of delivery or receipt of Entry will not be deemed by Sponsor as proof of entry. Any attempted form of entry other than described herein is void. Sponsor reserves the right to postpone, amend or modify the Contest for any reason, in the sole discretion of Sponsor. Entries become the property of Sponsor and will not be returned.

4. JUDGING/WINNER SELECTION: Up to five (5) Winners will be determined from among all eligible entries received. Entries will be judged on the following criteria: 1) Creativity (40%), 2) Passion/Personal Goal Statement (30%), 3) Understanding/Inclusion of Diversity (15%), and 4) Teacher Recommendation (15%). Judging will be performed by a panel of judges consisting of an independent judging organization, a panel of industry professionals, NBC Universal Executives, NAMIC, The Cable Center and Pickerel Pie (the “Judges”), whose decisions are final and binding in all matters relating to this Contest. The judging will take place on or about May 14, 2007. The Entries will be ranked based on their scores, from highest to lowest, in order to determine the winners. In the event of a tie, the entries involved in the tie are subject to review by an additional judge who will serve as a tiebreaker and who will evaluate entries according to criteria listed above. Winners will be notified via phone or express mail on or about May 22, 2007. As a condition of winning, the Parent or Legal Guardian of Winner will be required to sign and return, within 14 days of notification, an Affidavit of Eligibility and Release from Liability on behalf of a Minor (“Release”) and a statement affirming the Winner’s grant of all rights in the Video and the right to (where legal) use Winner’s name, likenesses and Entry in all media for promotional purposes to Sponsor and certifying that the Video submission is the original submission of the Entrant, the entrant has full rights to the Entry submission, that it has not been previously published, released or distributed, does not infringe any third party rights and is suitable for publication. The schools of the Winners will also have to complete a Liability and Publicity Release in order to receive the grant awarded along with the Prize stated. Failure to return any documents within the time specified or failure to respond to notification attempts or return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. Prizes awarded to minors will be awarded in the name of parent or legal guardian, who must execute the Release on behalf of the Winner. In the event a potential Winner is disqualified, the corresponding school will also be disqualified and will not be eligible to receive a grant.

5. PRIZES: Each of the Winners will receive a 6-Day/5-Night trip for two (2) to New York, NY. Trip includes round trip coach class air transportation for two (2) people from a major U.S. airport near Winner’s residence (Sponsor’s choice), hotel accommodations (standard room, double occupancy), ground transportation to/from airport/hotel and one (1) $1000 grant awarded to the winning student’s school (awarded in the form of a check to the school the student attended at the time they entered the Contest) (Estimated Retail Value (“ERV”): $4,200/ea.). Total ERV of all prizes: $21,000. Limit one prize per household. Prize package does not include taxes, insurance, telephone charges, personal expenses, gratuities, incidental charges, or any other items not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the Winner. The actual retail value (“ARV”) of the travel prizes may vary depending upon the point of departure and fare fluctuation. Trip must be taken between July 1, 2007 and August 31, 2007 on dates specified by the Sponsor or prize will be forfeited in its entirety. Some additional restrictions and blackout dates may apply. Final travel arrangements and choice of hotels to be determined by Sponsor in its sole discretion. If Winner is a minor, Winner must attend trip accompanied by a parent or legal guardian who must travel together on the same itinerary. Winner must confirm available travel dates and flight times selected by the Sponsor at least three (3) weeks prior to travel dates. No extension or change of trip dates permitted. Trip is subject to air/ground travel availability, hotel availability, and all other prize and travel restrictions, as applicable. Winner's travel companion (parent/legal guardian) must sign and return a Release of Liability/Publicity Release prior to the issuance of travel documents, except where prohibited by law. Failure to comply with these requirements may result in disqualification and the selection of an alternate winner. All prizes will be awarded, provided there are a sufficient number of eligible entries received. No transfer, substitution or cash equivalent for any prizes will be permitted, except at Sponsor's sole discretion due to prize unavailability for any reason, and only then for a prize of greater or equal value determined by Sponsor shall be allowed. In the event the closest airport to the winner’s home is the destination city, prize will not include air transportation and no other substitution or compensation will be provided. If, for any reason, a portion of the Prize cannot take place as planned, for any reason beyond the control of the Sponsor, then the remaining components of the Prize shall constitute full satisfaction of Sponsor’s prize obligation to the Winner, and no additional compensation will be awarded. Prizes are not transferable or redeemable for cash.

6. GENERAL: Contest is governed by the laws of the State of New York, with venue and jurisdiction in New York, NY and all claims must be resolved in the courts of New York, NY. By entering, Entrant/winner agrees: (1) to release Sponsor and its agents from all liability, loss or damage arising out of their participation in the Contest and with respect to their acceptance and use/misuse of the prizes; (2) to be bound by the Official Rules; (3) that the decisions of the judges are final and binding on all matters relating to the Contest; and (4) except in Tennessee and where otherwise prohibited by law, Sponsor, its successors, licensees and assigns may use their names, likenesses and entry submissions in connection with the Contest and for any advertising, publicity and promotion and promotional purposes in all media worldwide (including online) in perpetuity without additional compensation. Winner is responsible for all federal, state and local taxes. Parent/Legal Guardian, on behalf of Winner, will be issued an IRS 1099 Income Tax Form in the amount of the ARV of any prize accepted over $600. An Entry, except where prohibited by law, constitutes a grant of permission to the Sponsor or its agents to include Winners’ names on the http://www.nbcuontheset.com site and in connection with a Winners’ List without further notice or without additional compensation. Sponsor reserves the right to postpone, amend or modify the Contest for any reason, in the sole discretion of Sponsor.

7. WINNERS' LIST: For the names of “NBC UNIVERSAL ON THE SET” NATIONAL DIGITAL VIDEO CONTEST winners, available after July 23, 2007, send a stamped, self addressed envelope to be received no later than August 30, 2007, to: “NBC UNIVERSAL ON THE SET” NATIONAL DIGITAL VIDEO CONTEST WINNERS LIST REQUEST, Attention: G DaDan, 900 Sylvan Avenue, Englewood Cliffs, New Jersey 07632.
